Probate is the legal process that takes place after someone dies, ensuring the proper distribution of their assets and settlement of any debts. It involves validating the deceased’s will (if one exists), appointing an executor or personal representative to manage the estate, inventorying the deceased’s property, paying off outstanding debts and taxes, and then distributing the remaining assets as the will (or the law, if there’s no will) dictates. The process provides a systematic way to transfer ownership of assets, settle any disputes, and ensure that the deceased’s wishes are respected and fulfilled.

Probate Costs

Probate Application Service Breakdown:

  • Service Scope: If you need us solely for a Probate application, and the Estate size means no Inheritance Tax is due, with the Inheritance Tax form being the IHT205, then our service is available for you.
  • Fixed Fee: Our charge for this service is a fixed fee of £900.00. This fee is inclusive of VAT.
  • Probate Registry Fees: Currently, the Probate registry fees stand at £300.00. Any additional office copies will be charged at £1.50 each.
  • Swear Fees: For each Executor, there’s a swear fee of £7.00.

Please be aware: In choosing this service, we are only assisting in the Probate application. We will not be managing any distribution or collection of the assets.

Full Estate Management Service Breakdown:

  • Service Scope: Should you need assistance with the collection of all assets, settling all debts, and ensuring distributions to beneficiaries, we are here to facilitate.
  • Hourly Rate: Our service fee for this comprehensive task stands at £185.00 per hour, in addition to VAT.
  • Simple Estate Estimate: For an Estate that:
    • Excludes property,
    • Remains within the Inheritance Tax thresholds,
    • Comprises solely of funds in up to five or six bank accounts,
    • Has minimal debts,
    • Plans distributions to a maximum of five beneficiaries,

    Our anticipated engagement would be:

    • Time: Estimated between five to ten hours.
    • Cost: Ranging from £1,800.00 to £3,600.00, inclusive of VAT, with added disbursements.

If a property is included in the Estate then the fee is likely to be higher as there is likely to be additional work in connection with payment of bills relating to the property such as utility bills and there will be conveyancing costs in connection with the sale together with Estate Agents fees and so forth.  Currently the timescales involved in receiving probate from HMCTS is between 8 to 16 weeks.

The above information is based upon there being the following:

  • A valid Will
  • No disputes between beneficiaries on division of assets
  • No claim against the Estate in particular from the Benefits Agency for miss-payment of benefit or indeed any other claims.

Matters which are likely to increase the costs significantly are:

  • If there are a large number of individual assets
  • If there are a large number of individual debts
  • If the work we have to carry out includes us having to attend at the property, organise clearance of property and arrange the sale of the property
  • If the work we have to carry out includes us having to register the death and/or arrange the funeral
